Wyomissing Borough says procedural issue could affect conditional use approval for 915 Penn Avenue

The Borough of Wyomissing announced this week that a conditional use decision approved by Borough Council for a property at 915 Penn Avenue could potentially be voided due to a procedural issue involving public notice requirements.

According to the borough, Council approved the conditional use application during its regular meeting on May 12 following what officials described as a public review process. However, after the meeting, additional research determined that the public notice requirements did not precisely follow procedures outlined in the borough’s local ordinance.

In a statement, borough officials said the Court of Common Pleas could void the conditional use decision because of the notice issue. The borough also stated that Council is not permitted to withdraw the decision on its own.

Property owners impacted by the decision have until June 22 to file an appeal.

The borough said it recognizes the importance of transparency and noted that proper notice procedures are intended to ensure residents, applicants, public officials, and other interested parties have the opportunity to be informed and participate in the process.
